The Filing of nominations for the first phase of the Lok Sabha polls recently began as a necessary process for the general election set to be held from April to June.
What is the Nomination process?
- The filing of nomination begins with the Election Commission of India (ECI) issuing a notification on behalf of the President for the first phase.
- The nomination process is a step before elections, where eligible candidates from different political parties file their nomination papers.
- The rules and procedure for filing nomination are mentioned in the Conduct of Election part under the Representation of People Act, 1951.
- The candidates register their names with the Election Commission and claim that they are the right contenders to get public votes in the Lok Sabha election field.
- After examining all the certificates submitted by the candidates, the Election Commission decides their candidature for the Lok Sabha elections.
- Only after their candidature is finalized, the candidates can enter the election field spread their campaign and seek votes in their favor.
Who can file nomination?
- Any Indian citizen whose name is in the voter list can make nomination for the Lok Sabha seat.
- When a candidate is nominated by a political party, it is said that the candidate has got a ticket from the party.
- Whereas many independent candidates file their nominations with their symbols.
- The Election Commission examines their application for the symbol and allocates the party symbol after that.
How is nomination done?
- The candidates reach the office of the District Election Officer and submit the nomination form, to present their claim in the elections.
- Along with the nomination form, they also deposit the prescribed amount as security deposit.
- The candidate also has to submit an affidavit (prepared by the notary) along with the nomination paper.
- In the affidavit, the candidate has to give details of their income and expenditure and other important information.
- Along with the nomination form, candidates also have to give documents such as a passport-size photo, Aadhar card, PAN card, domicile, caste certificate, etc.
- The candidate has also to give the details of their movable and immovable properties, income, expenditure, and loans of their wife and dependent children.
- They also have to provide information about their educational qualifications, information related to weapons and jewellery they possess.
- If any criminal case is going on against the candidate, or a court case is registered or if punishment has been given in any case, they also have to inform the ECI.
What is the Withdrawal process?
- After filing the nomination papers, the nomination form and the information provided by the candidate are scrutinized by the Election Commission.
- A candidate can withdraw their name after a few days of nomination, based on the fixed time given by ECI.
- During that period, the candidate can withdraw his name as per their wish, in the form of a declaration on an affidavit.
